The rules that regulate and protect Genoese Basil DOP

The legislation governing Genoese Basil DOP begins with the application of European Union rules on the protection of typical products and involves the institutions.

The regulations that govern and protect Basilico Genovese DOP are issued in a pyramidal fashion, starting from the European Union and moving up to the Protection Consortium, passing through the Italian State.

Each body regulates its own area of competence by adopting the higher-level regulatory context.

EUROPEAN UNION

The European Union establishes precise rules to protect PDO and PGI products, establishing specific quality regulatory regimes to protect consumer good faith and provide producers with concrete tools to better identify and promote products with specific characteristics, as well as protect them from unfair practices.

European legislation:

Main provision : Regulation (EU) No. 1151/2012 of the European Parliament and of the Council on quality schemes for agricultural products and foodstuffs describes in detail the meaning of the acronyms PDO and PGI, specifying that: the PDO (Protected Designation of Origin) trademark identifies a product originating in a place, region or country, the quality or characteristics of which are essentially or exclusively due to a particular geographical environment and its intrinsic natural and human factors, and the production stages of which take place in the defined geographical area.

ITALIAN STATE

The State operates through the Ministry of Agricultural and Forestry Policies, which coordinates and supports certified products and recognizes and verifies the requirements of the Protection Consortia.

The legislation defines specific phases of the procedure at national and European level, categorizes the persons entitled to submit an application, and indicates the documentation to be produced.

The Ministry also manages the national DOP-IGP information portal: Quality, tourism, and agriculture for the promotion of the territory.

PROTECTION CONSORTIUM

It drafted and is responsible for the Genoese Basil DOP Production Regulations, which establish the rules for the origin, cultivation, packaging, and labeling of Genoese Basil DOP. The Consortium monitors the protection of the certified product from fraud and misleading advertising, in accordance with the Central Inspectorate for the Protection of Quality and the Repression of Fraud in Agri-food Products.

Liguria region

Develops programs to support and promote certified regional products.

ICQRF FRAUD REPRESSION

The Central Inspectorate for the Protection of Quality and the Suppression of Fraud in Agri-food Products supervises quality products and generally carries out functions of preventing and suppressing fraud in the trade of agri-food products and agricultural inputs, and combats their irregular marketing.

The Ministerial Decree of 12 October 2000 establishes the criteria for collaboration between the Protection Consortia recognised by the Ministry and the ICQRF (ministerial department for fraud repression and quality control).

ACCREDITED control body

Made in Quality is the inspection body authorized by the Ministry of Agricultural and Forestry Policies to carry out inspections for Genoese Basil DOP, coordinated by Unioncamere Liguria.

The Control Plan filed by Made in Quality with the Ministry guarantees the origin and quality of Genoese basil. It is structured according to the provisions of the production regulations and includes a series of requirements that must be followed by operators registered with the “Genoese Basil” DOP label.

The Certification Body meets the requirements and is authorized to operate in accordance with the UNI CEI EN ISO/IEC 17065 Standard: Requirements for bodies that certify products, processes and services.
